Purposes of Data Processing:

Contacting Us
You have the option to contact us via the email address listed in our legal notice (imprint). This contact takes place exclusively through the email program you use. The personal data you transmit to us in this context will only be processed to handle your inquiry.

The legal basis for this processing is Art. 6(1)(b) GDPR (performance of a contract or pre-contractual measures), insofar as you contact us in the context of a pre-contractual measure.
Otherwise, the legal basis is Art. 6(1)(f) GDPR (legitimate interest), as it is in both your and our interest to handle your inquiry.

Performance of Contract
If you have concluded a contract with us, we process your personal data for the purpose of contract execution. In particular, we process your name, address, and contact details (telephone numbers, email addresses) as well as financial information (bank details for billing purposes).

The legal basis for this processing is Art. 6(1)(b) GDPR (performance of a contract).

Applications (Recruiting)
You can apply for positions at KNSK via the email address provided in our legal notice (imprint) on our website. In this case, we process the personal data that you provide to us in your application. This includes, for example, your name, address, telephone number, and date of birth, as well as information about your specific professional background, including certificates, your CV, etc.

We collect this data in encrypted form and process it with the support of the service provider Personio GmbH, which we use as part of our applicant management process.

The legal basis for this processing is Art. 6(1)(b) GDPR, in the form of processing personal data required to carry out pre-contractual measures taken at your request.

Use of Google Analytics
If you have expressly consented to it when accessing our website, we use Google Analytics for our online presence — a web analysis service provided by Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google") — for the statistical analysis of the use of our website by our visitors.
Google Analytics uses so-called "cookies", i.e., text files that are stored on your computer and enable analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a server of Google in the USA and stored there.
If IP anonymization is activated on this website, your IP address will, however, be truncated by Google within Member States of the European Union or in other contracting states of the Agreement on the European Economic Area before being sent. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.
Google may use this information on our behalf to evaluate your use of the website, compile reports on website activity for us, and provide other services related to website and internet use.

The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.
You can prevent the storage of cookies by selecting the appropriate settings in your browser software; however, we would like to point out that in this case, you may not be able to use all functions of this website to their full extent. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address), as well as from processing this data, by downloading and installing the browser plugin available at the following link:
http://tools.google.com/dlpage/gaoptout?hl=de

The legal basis for the data processing described above by Google Analytics, in cases where personal data is processed, is Art. 6(1)(a) GDPR (consent) in conjunction with § 25(1) of the German Telecommunications and Telemedia Data Protection Act (TDDDG).

Social Media:

Facebook und Instagram
We link from our websites to our company pages on Facebook and Instagram, both services of Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
Please note that you use the Facebook and Instagram pages and their functions under your own responsibility. We have no influence over the data collection and further processing by Facebook. This applies in particular when using interactive functions (e.g., commenting, sharing, rating).

When visiting our company pages on Facebook and Instagram, Facebook collects, among other things, your IP address and other information that Facebook stores on your PC in the form of cookies with your consent. This information is used to provide us, as the operator of the pages, with anonymized statistical data regarding page usage.
The processing is intended to help us understand how our Facebook page is being used.
The legal basis for this processing is Art. 6(1)(a) GDPR (consent) in conjunction with § 25(1) TTDSG.
Since we are joint controllers with Facebook for this processing, we have concluded a joint controller agreement with Facebook, which specifies the distribution of data protection responsibilities between us and Facebook.
You can find more information and the agreement here:
https://de-de.facebook.com/legal/terms/page_controller_addendum

Please note that Facebook stores user data (e.g., personal information, IP address, etc.) and may also use it for its own commercial purposes. According to Facebook, IP addresses are anonymized (for German IP addresses) and deleted after 90 days. Facebook also stores information about users’ devices (e.g., through the “login notification” function); Facebook may thereby be able to assign IP addresses to individual users.
How Facebook uses data from visits to Facebook or Instagram pages for its own purposes, the extent to which user activity is assigned to individual users, how long Facebook stores this data, and whether data from a visit to the Facebook page is passed on to third parties is not fully and clearly stated by Facebook and is unknown to us.
Facebook may transfer your personal data to countries outside the European Union.

LinkedIn
We also maintain an online presence on LinkedIn, which we link to from our website. LinkedIn is provided by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland.
Please note that you use LinkedIn and its functionalities under your own responsibility. This applies especially to interactive functions like sharing.

LinkedIn is generally solely responsible for the processing of personal data when you visit our LinkedIn page. For more information on how LinkedIn processes personal data, visit:
https://www.linkedin.com/legal/privacy-policy

If you visit our LinkedIn page, follow it, or interact with it, LinkedIn processes personal data in order to provide us with anonymized statistics and insights about page usage ("Page Insights"). LinkedIn uses, for example, data you have already provided in your profile — such as job title, country, industry, experience level, company size, and employment status. LinkedIn also processes information on how you interact with our page, such as whether you follow us.
LinkedIn only sets cookies for this purpose with your express consent.
LinkedIn does not provide us with any personal data.
This data processing is carried out by LinkedIn and us as joint controllers. The purpose is to understand the use of our LinkedIn page.
The legal basis is Art. 6(1)(a) GDPR (consent) in conjunction with § 25(1) TTDSG.
We have a joint controller agreement with LinkedIn, which sets out the respective responsibilities.
You can view it here:
https://legal.linkedin.com/pages-joint-controller-addendum
You may assert your GDPR rights against LinkedIn at any time via this form:
https://www.linkedin.com/help/linkedin/ask/PPQ?lang=de
Or contact their Data Protection Officer here:
https://www.linkedin.com/help/linkedin/ask/TSO-DPO
You can also contact us, and we will forward your request to LinkedIn.
According to the joint controller agreement, the Irish Data Protection Commission is the lead supervisory authority. You may file a complaint at www.dataprotection.ie or with any other supervisory authority.

LinkedIn states that it transfers personal data to the USA or other third countries only where an adequacy decision exists per Art. 45 GDPR or based on appropriate safeguards under Art. 46 GDPR.

XING
We also link to our company page on XING, a service of New Work SE, Dammtorstraße 30, 20354 Hamburg.
In this context, we receive access to statistical evaluations about visits to our company page. These statistics are provided in aggregated and anonymized form and do not allow us to identify individual visitors. We use these evaluations to continuously improve and tailor the information we provide to the interests of our visitors.

If you are logged in to XING when visiting our page, information about your visit may be associated with your XING user account. This information may also be visible to us as the operator of the page. You can prevent this by logging out of XING before visiting our page.

When using interactive features of XING — such as liking, sharing, or commenting on posts — your personal data and activity may be visible to us and other visitors. This generally requires you to be logged in. We have no influence over the visibility of such interactions.
For details on how XING processes personal data, please refer to their privacy policy:  https://privacy.xing.com/de/datenschutzerklaerung

X (formerly Twitter)
We also link to the service X (formerly Twitter), operated by X Corp., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. The controller responsible for processing data within the EU or EEA is:
Twitter International Unlimited Company
One Cumberland Place,
Fenian Street, Dublin 2 D02 AX07, Ireland

If you use the short message service X and its functions (including interactive ones like sharing and rating), you do so at your own responsibility.
The privacy policy of X can be accessed here (PDF reader required):
https://cdn.cms-twdigitalassets.com/content/dam/legal-twitter/site-assets/privacy-page-gdpr/pdfs/Twitter-Privacy-Policy-DE.pdf

We have no control over the type, scope, or use of the data processed by X, nor over its potential disclosure to third parties. We also have no effective control mechanisms regarding this.
By using the service, X processes your personal data and may transfer, use, and store this data in the USA, Ireland, and any other country in which X does business.

X also analyzes the content you share to determine your interests, stores and processes direct messages, and can determine your location based on GPS data, wireless networks, or your IP address — in order to display ads or other content. We have no control over this.

X also collects technical data, even if you don’t have an account, when you view content on the platform.

Advertising
From time to time, we run Lead Ads, e.g., on LinkedIn. These are advertisements where clicking a download button opens a lead form.
Via this form, you can download a PDF that presents some of KNSK's services and offerings. To access the download, you must provide your first and last name, email address, and the name of the company you work for.
We store the data submitted through the form in our CRM system to potentially provide you with further information about KNSK.
Your data will not be shared with third parties or used for any other purpose.

The legal basis for processing your data for the purpose of downloading the PDF is Art. 6(1)(a) GDPR (consent).
The legal basis for using the submitted data for advertising purposes is Art. 6(1)(f) GDPR (legitimate interest).

Recipients of Personal Data:

We may transmit your personal data to companies within the KNSK GROUP GmbH for the purposes described above.
We also transmit your personal data to service providers, for example in the case of job applications to Personio GmbH, with whom we have concluded data processing agreements pursuant to Art. 28 GDPR.
The same applies to service providers who may have access to personal data in our systems (e.g., IT service providers).

Transfer to Third Countries
Your personal data will not be transferred to a third country — that is, a country outside the European Union (EU) or the European Economic Area (EEA).
Exceptions may apply to social media platforms on which we operate company pages. (→ see Social Media section)

Storage Duration / Criteria for Determining Duration
KNSK GROUP GmbH stores your personal data only as long as the purpose for which it was collected (see → Purposes of Data Processing) still applies.
If KNSK is legally obliged to retain personal data, storage will take place for the duration of the statutory retention obligation.
For example: For commercial documents, including accounting records and receipts (e.g., invoices), this is 8 years (§ 257(4) German Commercial Code – HGB).
Where no further processing purpose exists, your data may be blocked for operational reasons during the retention period.
If you provide us with data in the context of a job application, we will delete your data six months after the application process ends, unless an employment contract is concluded.
